MTN X VANDALEAK Contest Terms and Conditions

1. Company Organizing the Draw
The organizing entity of this draw is the MONTANA COLORS company, CIF B-60556065, registered at C/ Anaïs Nin, 12 Pol. Ind. Pla de les Vives, Sant Vicenç de Castellet, Barcelona Spain, 08295.

2. Purpose of the Draw
The purpose of this draw is to reward four users of the Vandaleak app with a pack of MONTANA COLORS products through shared publications of the pieces produced using the Vandaleak app. The pack will contain:
a) 1 MTN A4 Black Book
b) 1 Graphic Marker Basic Pack of 12
c) 1 Technical Marker – Pack of 7
d) 1 MTN CREW T-shirt
e) Pack of 20 MTN promotional stickers
f) Vandaleak credit worth €49
h) Vandaleak x MTN “My name is” sticker pack

3. Geographical scope and participants
This promotion is international.

4. Duration
The term of the promotion will begin on February 15th 2022 and will end on March 14th 2022 The four winners will be announced through the official Montana Colors Instagram @montana_colors on March 15th 2022.

5.Participants
Residents of any country in the world over 18 years of age who have downloaded the Vandaleak app on Google Play or the Apple Store can participate free of charge and voluntarily. They must actively participate in the draw according to the conditions detailed in this document. MONTANA COLORS workers, direct or indirect collaborators who have participated in the promotion or printing of the materials corresponding to them may not participate in said draw. The same applies to their relatives in the first degree.
If such a circumstance occurs, MONTANA COLORS will automatically discard these entires. MONTANA COLORS is not responsible for the veracity of the data provided by the participants or for not being able to contact the participants and/or winners if the data provided is not correct or contains errors.
This competition between the different participants will be carried out with equal opportunities and with strict respect for the rules. For this reason, MONTANA COLORS reserves the right to automatically and immediately exclude from it any participant who transgresses the rules of good faith, observes mendacious or inappropriate conduct, uses fraudulent means or fails to comply with these conditions. In the event that the irregularities are detected after the effective delivery of any of the prizes, MONTANA COLORS reserves the right to exercise the pertinent legal actions against its author or person in charge, among others, requesting the return of the prizes.

6. The Draw
There are four prizes for any user who:
1) Downloads the Vandaleak app
2) Generates at least one graffiti piece in the app
3) Publishes the result of the graffiti through the user’s Instagram profile
4) Includes the hashtag #MTNXVANDALEAK in the publication
The prize is personal and intransferable.

7. Prize Award System
The draw will be conducted through the EasyPromos platform. It will be a completely random draw in which all the publications made on Instagram that meet the requirements previously expressed in these conditions will be considered.
The winner authorizes their Instagram name to be published on the MONTANA COLORS social networks. The winner will be notified by DM. If the winner fails to comply with the rules of this draw or cannot be located within the terms of these conditions, the prize that would have been given will be discarded.
The participant must not include comments that violate or are likely to violate morality, ethics or good taste that infringe or violate intellectual or industrial property rights.You may incur consequences if you make an illicit or fraudulent use of them. MONTANA COLORS will act immediately in the event of a complaint or suspicion that infringements of intellectual property rights may be taking place, or in the event of any content that may be considered inappropriate and will proceed to eliminate it immediately, and may request the permanent blocking of the offending user.
MONTANA COLORS declines all responsibility for the consequences that the voluntary, consented and deliberate display by the user of their comments may have on themselves, their family, friends and/or relatives, or other third parties, or the dissemination or display of the same by you or by third parties, or its reproduction, including use in other web pages, blogs, social networks or in any other means, support or modality of digital exploitation or not, online or offline, given that both the publication of comments or the insertion of illustrations and texts, as well as their disclosure or dissemination to third parties, are totally voluntary, consented and not requested. Therefore, the participant will respond directly, keeping MONTANA COLORS free of responsibility against any claim, complaint or demand from third parties in relation to the violation or infringement of the possible rights that may derive from the texts or materials that a user has published. All images that violate the “Terms of Use” published on www.montanacolors.com or violate these rules will also be discarded.

8. Contact with the Winner
The winners will be contacted on March 7th by direct message through Instagram indicating that they have to send an email to montana@montanacolors.com with their personal information to send the prize.
In the event that any winner or winners do not respond within 24 hours, MONTANA COLORS reserves the right to name new winner(s) following the procedure described in these conditions.
In the event that said new winner(s) does not answer, MONTANA COLORS may declare the prize void.

9. Relationship with Instagram
Instagram does not in any way sponsor, endorse or administer this promotion, nor is it associated with it. The information you provide will only be used to process the participant’s participation and to notify them of the prize in the event that they are the winner.

10. Taxation
The planned draw, as well as the awarding of the prize, are subject to current tax regulations.

11. Acceptance of the Conditions
The participation implies the acceptance of these bases in their entirety, so the manifestation, in the sense of non-acceptance of the same, will imply the exclusion of the participant and, as a consequence of it, MONTANA COLORS will be released of compliance with the obligation contracted with said participant. By accepting the prize, the winner assumes all the expenses incurred, except those that are expressly included in the promotion in question, as well as the responsibility that may arise from the collection and use of said prize.

14. Intellectual property rights
MONTANA COLORS reserves the right to use the names and images of the winning participants as well as of all the participants for the purpose of using them for advertising purposes in the media they deem appropriate and without the need for explicit notification.

15. Personal Data
In accordance with the Organic Law on the Protection of Personal Data and the Law on Services of the Information Society and Electronic Commerce, participants are informed that the personal data they provide will be incorporated into a personal data file owned by the organizing company. Said data will be used and processed, in addition to the purpose of participating in the draw, for the investigation, promotion and commercialization of MONTANA COLORS services, which will include the sending of commercial communications, even electronically. If they wish, they can make use of their rights of access, rectification, opposition and cancellation of their data at any time by writing to the data controller at the email address indicated below: montana@montanacolors.com.

16. Applicable Law and Competent Courts
The law applicable to this promotional draw is Spanish law, and the competent courts to hear any conflict or controversy are the Courts of the city of Manresa.
